Professional secrecy in the digital age: precautions every lawyer should take

Professional secrecy is one of the pillars of legal practice, set out in the Statute and in the Code of Ethics. It was born in a world of folders and steel filing cabinets, but today most confidential information is on screens, in the cloud and on phones.

Where confidentiality is at risk

  • Personal messaging apps, with client documents mixed in with family chats;
  • E-mails sent to the wrong recipient or with unprotected attachments;
  • Shared computers and open sessions;
  • USB drives and downloads scattered across personal machines;
  • AI tools with no guarantees about how the data entered is used.

Practical measures

  1. Centralize client documents in a system with access control, not in personal folders;
  2. Use strong passwords and two-step verification;
  3. Limit each team member's access to what they need;
  4. Avoid entering identifiable client data into tools without an adequate contract and privacy policy;
  5. Keep backups — losing a document is also an incident.

Confidentiality and data protection go together

Brazil's data protection law requires security measures proportionate to the risks. For lawyers, these measures reinforce a duty that already existed — and documenting the practices adopted also protects the firm.

A word about training
